What is the Difference Between Contested and Uncontested Divorces?

In an ideal world, a couple who is struggling with their marriage would end their relationship amicably. They would agree on all the key issues and get the divorce finalized quickly and easily.

But if you have ever been through a divorce or know someone who has, you know that’s rarely the case. Divorces are often messy, with the parties arguing over children, alimony, assets, or some other issue. The process can take what seems like forever.

Divorces tend to be contested, but they can be uncontested in some cases. What do these terms mean? Read on to learn more.

Contested Divorce

Contested divorces are when a couple disagrees on at least one aspect of the divorce. This may include child custody, parenting time, child support, alimony, and asset division. There may be disputes over who gets what assets, how debts should be split, custody arrangements, visitation rights, financial support for the children, and whether alimony should be awarded and how much. As you can see, children often cause divorces to become contested.

A contested divorce can be resolved through mediation, although many cases go to court.

Still, a contested divorce can take longer than a year to finalize. It can be much more expensive. Plus, it can be very stressful for all involved.

Uncontested Divorce

An uncontested divorce, on the other hand, is when both parties agree on all issues surrounding their divorce. You can get a divorce quickly under this method, but you will need to file based on grounds called ‘irreconcilable differences’. This requires you to demonstrate that the marriage has been deteriorating for at least six months. If you choose this route, your divorce may be finalized as soon as your joint paperwork is completed, filed, and approved by the court.

An uncontested divorce in New Jersey typically takes 3 to 6 months. The process tends to be quicker and less stressful than a contested divorce. Plus, there is less court involvement, which means more privacy.

Just make sure to file the appropriate forms and pay the required fees. Even if your divorce is uncontested, it can be helpful to have a divorce lawyer on your side to guide you through the process.
